These Terms and Conditions (“Terms”) govern all naturopathic consultations and related services provided by Nozomi Naturopath (“we,” “us,” or “our”). By booking a consultation or purchasing related products, you (“the client”) agree to the following terms.
1. Services
We provide online and in-person naturopathic consultations, and may recommend or facilitate the purchase of supplements, herbal remedies, and related products supplied by third-party providers. 2. Fees & Payment Terms
Orders and Availability
All orders for products or services are subject to availability.
A contract for sale is only formed once your order is accepted by Nozomi Naturopath.
Orders Placed with Third-Party Suppliers
Some products may be provided by third-party suppliers (e.g., Vital.ly, Ariya, Natural Script).
We are not responsible for any orders placed directly with these suppliers.
If you purchase from third-party suppliers, you agree to comply with their terms and conditions and all applicable laws.
Fees
Fees for consultations, products, or other services are set out on the website or otherwise communicated in writing.
All fees are quoted in Australian dollars (AUD).
GST, where applicable, will be added to the fee.
Fees may be updated at any time, with notice to clients.
If you are based outside of Australia, you are responsible for all customs, import taxes, and duties on your orders.
Payment Terms
A 20% deposit is required at the time of booking to secure consultations.
The remaining balance is payable after your consultation, via SimpleClinic checkout or Square.
Payment terms vary depending on the products or services you purchase.
By placing an order or booking a service, you agree to pay according to the payment terms communicated to you.
Client Responsibilities
You agree to:
Complete any intake, consent, or follow-up forms requested by Nozomi Naturopath;
Provide accurate, current, and complete information about yourself (or your child, if you are a parent or legal guardian acting on their behalf); and
Keep us informed of any changes to your health or relevant personal details during the time you receive our services or products.
This includes (but is not limited to) notifying us of:
Current and past medical conditions;
Medical professionals currently involved in your care;
Any known allergies, food intolerances, medications, or supplements (including dosage changes);
Recent vaccinations or boosters;
Whether you are vegan or vegetarian (as some products may contain animal-derived ingredients); and
Whether you are pregnant, breastfeeding, or trying to conceive.
You acknowledge that the accuracy and completeness of this information are essential to the safe and effective delivery of our services and recommendations.
3. Cancellations and Rescheduling
A minimum of 12 hours’ notice is required for cancellations or rescheduling.
A $40 fee will apply to cancellations made with less than 6 hours’ notice or to no-shows.
Repeated cancellations or missed appointments may result in refusal of future bookings.
4. Refunds
Deposits are non-refundable except in exceptional circumstances at our discretion.
If we are required to cancel a session, clients will be offered a full refund or reschedule option.
5. Third-Party Products
Any supplements or herbal remedies recommended during consultations are supplied through third-party providers.
We do not guarantee the quality, safety, or efficacy of third-party products and accept no liability for adverse effects arising from their use.
6. Disclaimer
All information provided during consultations is for educational and informational purposes only.
It is not intended to diagnose, treat, cure, or prevent any disease, nor replace medical advice from a qualified healthcare provider.
Clients should consult their primary healthcare professional regarding any medical concerns.
7. Confidentiality and Privacy
All client information is treated as confidential and handled in accordance with the Australian Privacy Principles.

8. Limitation of Liability
To the maximum extent permitted by law, Nozomi Naturopath shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our services or products.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
10. Clients Based Outside Australia
If you are located outside of Australia, it is your responsibility to ensure that any products or services ordered from Nozomi Naturopath may be lawfully ordered, imported, and used in your country or region.
We are not responsible or liable for any products being delayed, confiscated, or otherwise restricted under local laws or customs regulations in your area.
11. Refusal of Service
We reserve the right, at our sole discretion, to refuse or discontinue services to any client who fails to comply with these Terms and Conditions, provides false or misleading information, behaves in a disrespectful or unsafe manner, or otherwise compromises the integrity of the practitioner-client relationship.
12. Notification of Issues with Products
Products Purchased from Us
If there are any issues with a product you purchase directly from me (e.g., shortages, damage, or incorrect items), please notify me within 7 days of delivery. You can contact me via the address or method listed on our website.
When notifying, please include:
Proof of purchase
Full details of the issue
Any other relevant documentation reasonably requested
If the product needs to be returned, you will be responsible for the cost of transport and insurance to and from us.
Products Purchased from a Third Party
If your order was placed directly with a third-party supplier (e.g., Vital.ly, Ariya, Natural Script), please contact the third party directly regarding any issues.
Delivery and Risk
Delivery to a carrier is considered delivery to you.
The risk of the product transfers to you once the product is handed over to the carrier.
No Limitation on Your Statutory Rights
Nothing in these Terms affects your rights under Australian consumer law.
We do not provide warranties or representations beyond those stated in this section, and any limitations or exclusions of liability are only to the extent permitted by law.
13. Consumer Guarantees & Refunds
Consumer Guarantees
Our products and services come with certain guarantees under the Australian Consumer Law (ACL) that cannot be excluded.
For major failures:
You may cancel your service contract and obtain a refund for the unused portion or compensation for its reduced value.
For products, you may choose a refund or replacement.
For failures that do not amount to a major failure, you are entitled to have the issue rectified within a reasonable time.
If it is not rectified, you may receive a refund for products or cancel the service contract and obtain a refund for any unused portion.
You may also be entitled to compensation for reasonably foreseeable loss or damage caused by the failure.
These rights are in addition to any other rights and remedies available at law. Our liability is limited to the remedies outlined in this section.
Refunds
Refunds are only provided if:
We cannot fill your order, or
We reasonably agree to provide a refund, or
Otherwise agreed in writing.
Please choose carefully, as refunds are not available simply for a change of mind.
14. Warranty & Allergies
Warranty
Subject to the clauses on statutory rights, consumer guarantees, and limitation of liability, I warrant that services will be provided free from defects in materials and workmanship under normal use.
For products, this warranty applies up to the expiry or best-before date indicated on the product (if any) — referred to as the Warranty Period.
No Liability for Allergies or Reactions
Some products (whether purchased from me or third-party suppliers) may contain ingredients that:
Are derived from nuts or other allergens,
Contain gluten, dairy, or other substances, or
May be contraindicated in certain conditions, including pregnancy.
It is your responsibility to read the ingredients list before purchasing and to contact me if unsure whether a product is suitable.
If you experience an allergic or adverse reaction, please discontinue use immediately and contact me.
By purchasing products, you agree that I cannot be held liable for allergic or adverse reactions and that products cannot be exchanged or refunded due to allergic or adverse reactions.
15. Limitation of Liability & Returns
Limitation of Liability
Suppose any product or service fails to comply with the warranties outlined in the Warranty & Consumer Guarantees sections, and you make a valid warranty claim within the Warranty Period. In that case, my liability is limited, at my sole discretion, to:
Products: replacing the goods or supplying equivalent goods;
Services: supplying the services again or covering the cost of supplying the services again.
When Returns Will Not Be Accepted
Subject to your statutory rights under Australian law, this warranty does not apply, and products cannot be returned in the following circumstances:
The goods have not been stored or used appropriately.
The goods have been altered in any way;
The goods are not in their original condition or packaging;
Instructions or guidelines provided by me or on the packaging have not been followed.
The goods have been used after a defect became apparent (or would have become apparent to a reasonably prudent user);
Loss or damage occurs due to accidents or Force Majeure events.
